DMCA Policy
IMAX Waikiki respects the intellectual property rights of others. We comply with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws. Our commitment ensures that original content published on our platform, including articles on automation, real estate, and related topics, is respected, and any infringing material is addressed promptly.
This policy outlines the procedures for copyright holders to request the removal of content they believe infringes upon their work. It also details the process for those who believe their content was removed in error.
Filing a DMCA Takedown Notice
If you are a copyright owner or an agent authorized to act on a copyright owner’s behalf, and you believe that content available on imaxwaikiki.com infringes upon your copyrights, you may send a DMCA notice to our designated agent. We require all such notices to be in writing and comply with the DMCA requirements.
Your notice must include the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit IMAX Waikiki to locate the material (e.g., specific URLs).
- Information reasonably sufficient to permit IMAX Waikiki to contact you, such as an address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please send your complete DMCA takedown notice to our designated agent via email: [email protected].
Counter-Notification Process
If you believe that your content was removed by mistake or misidentification, you may submit a counter-notification. This allows us to restore the content, subject to certain conditions. A counter-notification must be a written communication provided to our designated agent.
Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which IMAX Waikiki may be found. You must also agree to accept service of process from the person who provided the original DMCA notification or an agent of such person.
Send your counter-notification to [email protected]. We will review it and may restore the content within 10 to 14 business days unless the copyright owner files a court action seeking a court order to restrain the user from engaging in infringing activity.
